Santa Clarita Valley Home Owners Associations (HOA) why would you want one?

    Home with HOAs and homes without HOAs in Santa Clarita CitiesWe get the statement from home buyers interested in the Santa Clarita Valley, “I don’t want a home that has an HOA!”

    HOA – Home Owners Association

    That’s great and I am to serve my real estate clients with getting what they want.

    However, there are homes in the Santa Clarita Valley that do not have Home Owners Associations. But, they are not as common as homes that have them.

    Some HOA fee’s pay for things you can see. Park maintenance, green belt upkeep, pools, activity centers, building code enforcement, clubhouses, security patrols and more.

    With other Home Owners Associations, it’s somewhat hard to tell.

    Some HOA’s also work well as an enforcement mechanism.

    If you have a neighbor that paints their home exterior like Madonna did her Hollywood home, Orange and Black, you can call the HOA because that is probably a violation of the CC&R’s.

    Ah – the good old CC&R’s. Covenants, Conditions, and Restrictions. These refer to a rule book that is continuously updated and modified by the HOA rank and file. In some, less active, HOA controlled communities the CC&R’s have not been changed in any way since their inception.

    Another reason to attend the board meetings for your HOA, to ensure there are not going to be any changes to the CC&R’s that you would be able to live with.

    Some of the HOA’s have CC&R’s that limit numbers of pets, types of pets, size of pets, washing cars in public, parking of RV’s, parking of boats, and more.

    Typically the first defense of the HOA is by “warning”. A written warning to notify the homeowner of their violation is the first step of enforcement of the CC&Rs.

    You may receive a letter that the front of your garage door is in need of new paint. Maybe an exterior gate that is within public view needs to be painted. Things like these are some of the “letters of potential action” that are generated by the HOA. In these letters, the HOA will usually quote chapter and verse as to which CC&R was violated.

    If your neighbors are not picking up the feces created by their pets, then HOA maybe a good tool to be used by the neighbor waking up the pungent aroma.

    The CC&R’s can be enforced by the HOA via many different mechanisms. If the HOA has secured a private security company, this too may be used as an enforcement mechanism, depending on the “reach” granted.

    HOA’s, some like them, some don’t. Make sure you ask your qualified Realtor which areas have them and which do not so you can be ensured to get what you want.
